Frequently Asked Questions
Everything you need to know before hiring your first person in Vietnam.
What is an Employer of Record?
An Employer of Record is a company that legally employs staff on another company’s behalf. The client directs the work day-to-day; the Employer of Record holds the employment contract and takes responsibility for payroll, statutory contributions, benefits and employment compliance in that country. Talent JDI is a MoLSW-licensed Employer of Record in Vietnam.
Can I hire in Vietnam without a local entity?
Yes. Talent JDI employs the person in Vietnam under a Labour Code-compliant contract issued by our licensed local entity, runs payroll, registers and remits SHUI, and files personal income tax. You direct the work, set priorities and manage performance. No incorporation, payroll system or in-country HR function is required.
How long does EOR onboarding take in Vietnam?
Three business days from contract signature to the first working day. Talent JDI drafts the employment contract within 48 hours of the brief, then registers the employee under our entity, completes SHUI registration, activates PIT and integrates payroll. Average onboarding across our client base is five days.
How much are employer social insurance contributions in Vietnam?
Employer-side contributions are 17.5% for social insurance, 3% for health insurance and 1% for unemployment insurance. Employees contribute 10.5%. Contributions are capped at 20 times the regional minimum wage. Talent JDI calculates, remits and reports all of it, and sets out the full cost of employment before you commit.
How is personal income tax handled?
Vietnamese personal income tax runs on a progressive scale from 5% to 35%. Talent JDI withholds PIT monthly, files the declarations, completes the annual finalisation and documents dependant deductions, applying the personal deduction of VND 11,000,000 per month and VND 4,400,000 per dependant.
What is the difference between EOR and PEO?
Under an Employer of Record, Talent JDI is the sole legal employer and you need no Vietnamese entity. Under a PEO, or co-employment arrangement, you keep your own entity and the provider runs HR, payroll and compliance alongside it. Talent JDI offers both, and the consultation establishes which structure fits.
Who manages the employee day to day?
You do. Talent JDI is the legal employer and handles the contract, payroll, SHUI, PIT and HR compliance; you set priorities, direct the work and manage performance. In a Full Managed Team engagement we can also supply technical leadership on the ground, but the work direction stays with you.
Is Talent JDI licensed to employ staff in Vietnam?
Yes. Talent JDI is licensed by the Vietnam Ministry of Labour and Social Welfare and has more than ten years of compliant hiring operations in the country. JDI Group contracts through a Singapore entity and was recognised by The Straits Times as one of Singapore’s Fastest Growing Companies 2025.
How much does an Employer of Record in Vietnam cost?
Talent JDI quotes the full cost of employment rather than a headline salary: gross pay, employer SHUI contributions, benefits and the management fee, set out per employee in a single monthly invoice. The consultation is free, and the Vietnam Tech Salary Guide gives current benchmarks so you can budget before briefing a role.
What happens when we set up our own Vietnamese entity?
Launch JDI, another JDI Group business unit, handles company incorporation, corporate secretarial work, bookkeeping, tax filing and legal consultancy in Vietnam. Clients commonly start under Employer of Record and incorporate once the team justifies it, transferring employment across without changing providers or losing anyone.
